LINK’S PRIVACY POLICY

LINK’S GOLF SHACK LLC (collectively, “LINK’S”, “we”, “us” or “are”) occasionally collect essential information for the purposes of conducting transactions with our customers. This privacy policy (or “policy”) is designed to inform you of: (a) types of information we may collect; (b) what your choices are with regards to the information we collect; and (c) the ways we collect, secure, use, share and update the information we collect. This Policy applies to the ways and types of information LINK’S collects through business operations through our website, smart device sites (mobile phones, tablets, game counsels, etc.) social media, applications (apps), messaging platforms such as email marketing or text messages, even registration, and contests and promotions (Individually a “Site” and collectively, our “Sites”). Social media, digital and on-line marketing campaigns, and email communication are collectively referred to as “Internet Marketing Channels”. This policy does not pertain to 3rd party vendor use of information, such as payment processors (Square, PayPal, Apple Pay, etc.), which have their own Privacy Policies.

I. Categories of Information Collected

Some information we collect during a transaction or via communication with you is considered “Personal Information.” Personal Information is information that identifies you individually. (1) Create an account with LINK’S (online shopping cart, account to track shipping or review products, a loyalty account, or any other type of account);

(8) Fila a claim or request an investigation into product lost or damaged during shipping; or

  1. Information We Receive From Third Parties.LINK’S may receive information which you provided to third parties, or which third parties provide on your behalf. Such information made include, but is not limited to, purchases, gift recipients, online event registrations, or any other information resulting from interactions with other users conducting business on your behalf related to LINK’S.

We may receive information from third-party sources assisting us with (a) analyzing, improving, or updating our records or data; (b) conducting market research services; or (c) conducting fraud investigations. We may also receive information from consumer reporting agencies and service providers.

LINK’S may work with third-party service providers to obtain feedback regarding our web site, mobile applications, or general information such as web site browsing patterns design to improve our web site, mobile application, and marketing processes. Analytics service providers may provide LINK’S with information from analyzing your visit to our web site.   1. Passively collected information from your use of our web site.Any time you visit or interact with LINK’S through our web site or mobile application on your personal browsing device (which include Wi-Fi and Bluetooth), “User Activity Information” may be collected through Cookies, Web Beacons and other related technologies (collectively, “Information Technologies“). A “Cookie” is a small text file that is sent to your device while visiting our web site or other internet marketing channel, which is saved on your device via your browser. A “Web Beacon” is a common type of web technology used on our web site and internet marketing channels which monitors visits and interactions with or within our web site to measure the effectiveness of  our web site and internet marketing channels.

Information and activity that we collect through Information Technologies includes:  internet protocol (IP) addresses, device characteristics (including operating system, connection and browser type, etc.), user location information, user ID, and your various interactions within our Sites, mobile application,  and Internet Marketing Channels (including web site paged visited, keyword searches, and specific products or product categories viewed). Other user activity information may include: your mobile device if used to visit our web site (device model, operating system, unique identifiers, and mobile network information); how you use our web site and internet marketing channel, and information such as your search terms, and pages visited. While LINK’S will only share Personal Information for the specific purposes identified in this Privacy Policy, Internet Marketing Channels may use collected information from our web site for their own purposes independently of LINK’S.

  1. Social Media Access. LINK’S engages with customers and prospective customers through social media (e.g. Facebook, Instagram), as well as Internet Marketing Channels. Should you contact us or request customer service on one or more of our Social Media platforms or Internet Marketing Channels, we may contact you via these social media or direct message platforms in order to interact with you. In such instances, your interactions with us are governed by our Privacy Policy, as well as any privacy policy directly representing the social media platform which you use. By accessing, linking to, or engaging with our Web Site or Internet Marketing Channels, or any other third-party social media platform, you are giving LINK’S permission to access and use any information you post or save on the applicable social media platform in accordance with that platforms posted privacy policy, as well as the privacy settings which you have applied to your personal account. You further give permission to store the username and password that you use to log-in to each social media platform you use. When you access or log into our web site or any of our social media platforms or Internet Marketing Channels via any social media services, any information you have provided may be accessible to that service and is automatically subject to that service’s privacy policy. If you would like more information on managing the information provided to LINK’S by these social media services, please review each social media services posted privacy settings, and the privacy settings you have set up with your social media services. LINK’S has no control over, and is not responsible for, the privacy practices of any social media platforms.
  2. Other Information. In addition to the collection of any Personal Information referenced above, LINK’S may collect information that does not identify you and is in no way associated with your Personal Information. LINK’S may also de-identify information to ensure it no longer identifies you. In doing so, we may use that information conduct marketing activities in a way that will not compromise your Personal Information. Such activity is deemed outside the scope of our Privacy Policy.

II. Your Choices

As a customer, you have a number of choices regarding our collection, use and disclosure of your personal information:

  1. Email Opt-Out.You may unsubscribe from receiving promotional e-mail communications by clicking on the unsubscribe link provided in our e-mail communications. Even if you opt out of receiving promotional email communications, LINK’S may contact you I response to an inquiry you submit (e.g. shipping notification, product recalls, shipment notification, etc.).
  2. Disabling Cookies.Based upon your interactions with our Web Site and Internet Marketing Channels, LINK’S may personalize your experience on our Web Site and via our Internet Marketing Channels. You may have choices regarding how your device interacts with our Web Site and Internet Marketing Channels. If you choose to restrict information, such as your browsing history on our Web Site, you can still access our Web Site and Internet Marketing Channels but may not be able to take full advantage of all available features. You may manage third-party tracking by turning off your cookies.

Your device browser may offer personal preferences regarding how a website may collect your information and online activity, allowing you to modify your personal preferences.

  1. Location Information.When you visit our Web Site, information may be collected regarding your general location from your IP address, as well as your latitude and longitude from your browser. You have the ability to opt-out of allowing LINK’S to use your specific location information that is obtained when you visit our Web Site when your browser prompts you to allow or not allow our LINK’S to use your location information. You may also manage this in your browser settings. Opting out of allowing LINK’S to use your location information will not limit our ability to use your general location obtained from your IP address.
  2. Mobile Device and Application Preferences.

(1)    Text Messages. If you have signed up for the receipt of text messages from LINK’S, we may occasionally send text messages to the phone number you provided that corresponds with your personal device. To opt out of receiving text messages to your device, simply reply “STOP” to one of the messages. This opts you out of all future text messages.

(2)    Push Notifications. If you wish to opt out of push notifications, simply adjust the permissions in your mobile device.

(3)    Location Information. If you wish to opt out of sharing your location information, simply adjust the permissions in your mobile device.

III. How LINK’S Uses Your Information

We only use your personal information consistent with the below Policy and all applicable laws in the following ways:

  1. Fulfilling your orders, delivering your product, and communicating updates about the shipment and delivery of your products and services.
  2. Maintaining LINK’S’s loyalty program.
  3. Processing your return or exchange transactions.

For example, if you have expressed an interest in shopping for golf, we may target you with golf-related products. In addition to such tailoring, we use User Activity Information to ensure that our online presence operates properly and efficiently for you and for your individual customer experience, to evaluate the use and benefit of such presence, and to support our Sites and our Internet Marketing Channels; and
  3. Use location information from your device in order to deliver marketing messages to you which may be more relevant to your general location. We may also use this data to track the effectiveness of local marketing campaigns, as well as our store location services.

IV. How We Disclose Your Information

We may share your information (including Personal Information) with the following categories of third parties where consistent with this Policy and applicable laws:

  1. We use third party companies, such as payment processors, shipping providers, marketing / email / text service providers, software vendors, and financial institutions. While we have no involvement in the business operations of third party companies, their user agreements typically obligate them to use reasonable methods to keep any Personal Information safe and secure, and not use such Personal Information for purposes other than providing their applicable services, or as otherwise described in this policy. In purchasing merchandise or services from LINK’S, subscribing to our Text or Email marketing program, communicating with us, or conducting business with us in any way, you understand that we are not responsible for the use of personal information obtained by a third party business.
  2. To comply with applicable city, state, or federal laws, or as requested based upon governmental regulations, subpoenas, or court orders.
  3. As required or deemed necessary to protect the privacy, safety, and rights of our LINK’S customers and Team Members, and to assist with investigations into suspected or actual fraud or any other unlawful activity perpetrated against us, our Team Members, or our customers.
  4.    When permitted by law as related to aspects of our business including the sale and shipping of products, and user tracking related to targeted cookies, etc.
  5. Any other situations disclosed at the time data is collected.

V. How You Can Update Your Information

  1. If you have information you need to update, such as address changes related to the receipt of product, email or phone numbers associated with our Text / Email programs, etc., you may contact us directly using the contact form found in the bottom site menu of all pages on our web site.

Please note:

  1. Link’s may need to deny information change requests if they risk the privacy of other people, or they are impractical or unreasonably repetitive or labor intensive.
  2. Upon the update, or deletion / closure of an account or of any of your personal information, residual copies of information may remain on our servers and back-up systems as permitted to the extent permitted by the law.

VI. Security and Retention

Link’s uses a variety of security measures to assist in protecting Personal Information and transactions that we process. Our web site utilizes encryption technology to protect Personal Information transported via the internet. Customer account information is protected with password restricted access.

We also use security measures to assist in protecting personal information that we maintain. While no company can guarantee the absolute security of your information, we take every precaution to reduce risks.

Information is retained for a variety of reasons, such as business purposes while your account is still active, as long as is required to provide you with your ordered products and services; and as long as is necessary to comply with any legal obligations or to resolve disputes or enforce our agreements. Information managed or retained by third parties supporting Link’s business operations maintain their own retention policies. 

VII. Privacy Policy Updates

We periodically update our Privacy Policy. Updates will be posted to the Privacy Policy page on our web site, located in the site menu at the bottom of all pages. Should we make any significant change to how we use your information that adversely affects your rights, we will provide you with thirty-day advanced notice to via the contact information we have stored for you. If you do not agree with our policy changes, you may stop using the Link’s website, and if you have an account with us, you should cancel your account with us within the thirty day period by contacting us via our contact form located on our web site.
